Agreement to Terms

Please read these Terms of Service carefully before using Giga Maps, including our websites, mobile applications, maps, address resolution tools, claimed-place features, saved places, address customization, Giga AI chat, subscriptions, and related services. Giga Maps is provided by SmartAddress, Inc. References to "we," "us," and "our" mean SmartAddress, Inc.

By accessing or using Giga Maps, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use Giga Maps.

Eligibility

Giga Maps is not intended for children under 13. You may use Giga Maps only if you can form a binding agreement under applicable law and are not prohibited from using the service by the laws of the country or region where you are located.

Service Description

Giga Maps provides tools to resolve real-world places, coordinates, street addresses, and AI Addresses into AI-native address identities. Features may include map search, pin dropping, current-location resolution, saved places, claimed places, address customization, Giga AI conversations and address suggestions, directions links, account features, subscriptions, and related services.

Address Results

Giga Maps address results, coordinates, map markers, AI Addresses, directions links, claim status, customized address identities, AI-generated responses, and address suggestions are provided for convenience and product use. They may be incomplete, inaccurate, delayed, unavailable, or unsuitable for a particular use.

You are responsible for verifying destination, safety, emergency, delivery, legal, property, business, or commercial information before relying on it. Giga Maps is not an emergency service, navigation safety system, land title system, legal registry, or official postal authority.

Claims and Customization

If you claim a place or customize an AI Address, you represent that you have the right or appropriate relationship to do so and that the information you provide is accurate, lawful, and not misleading. Claimed places and customized address identities may be public or visible to other users when those places are resolved.

We may approve, reject, modify, restrict, transfer, suspend, or remove claims or customizations at any time, including if we believe they are inaccurate, infringing, abusive, confusing, harmful, unlawful, inactive, or inconsistent with the service.

User Content and Conduct

You are responsible for information, text, names, tags, claims, custom address words, AI chat prompts and messages, support messages, and other content you submit through Giga Maps. You agree not to submit or use content that is unlawful, false, misleading, infringing, defamatory, obscene, harassing, threatening, abusive, discriminatory, invasive of privacy, or otherwise harmful.

You may not access or attempt to access Giga Maps through automated means such as scripts, crawlers, scrapers, bots, or spiders without our prior written permission. You may not interfere with the service, bypass access controls, misuse APIs, forge identifiers, overload infrastructure, or attempt to reverse engineer non-public portions of the service.

Roadmap and Future Features

Descriptions of location intelligence, marketplaces, programmable wallets, x402 payments, agentic commerce, fulfillment, delivery, or other future capabilities describe our vision or roadmap unless a feature is expressly identified as currently available. They are not promises, guarantees, or commitments that a feature will launch or be available on a particular date or under particular terms.

Subscriptions and Payments

Some features may require a paid subscription or purchase. Prices, features, limits, renewal terms, and availability may change over time. Payments may be processed by app stores, payment providers, or other third parties, and their terms may also apply. Unless otherwise required by law or stated in the applicable purchase flow, fees are non-refundable.

Third-Party Services

Giga Maps may include third-party features, links, content, maps, directions, app stores, payment providers, or services. Google Maps features and content are subject to the Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy.

We do not control and are not responsible for third-party websites, services, content, policies, or practices.

Intellectual Property

Giga Maps, including its software, design, features, functionality, content, trademarks, logos, and trade dress, is owned by SmartAddress, Inc. or its licensors and is protected by copyright, trademark, and other laws. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from Giga Maps except as permitted by law or with our prior written permission.

If you submit content to Giga Maps, you grant SmartAddress, Inc. a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, display, publish, distribute, and otherwise use that content as needed to operate, improve, market, and provide Giga Maps.

Termination

We may suspend, restrict, or terminate access to Giga Maps at any time, with or without notice, including if we believe you violated these Terms or created risk for users, third parties, or the service. You may stop using Giga Maps at any time. Provisions that by their nature should survive termination will survive, including ownership, disclaimers, indemnity, limitations of liability, and governing law.

Indemnification

You agree to defend, indemnify, and hold harmless SmartAddress, Inc., its affiliates, licensors, service providers, officers, directors, employees, contractors, and agents from and against claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising from or related to your use of Giga Maps, your content, your claims or customizations, or your violation of these Terms or applicable law.

Disclaimer

Giga Maps is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, security, or reliability. We do not warrant that Giga Maps will be uninterrupted, error-free, secure, or free of harmful components, or that address results will meet your requirements.

Limitation of Liability

To the maximum extent permitted by law, SmartAddress, Inc. and its affiliates, licensors, service providers, officers, directors, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, use, or other intangible losses, arising from or related to your use of or inability to use Giga Maps.

Changes and Availability

We may modify, suspend, discontinue, or limit Giga Maps or any part of it at any time without notice. We may also update these Terms from time to time. If changes become effective and you continue to use Giga Maps, you agree to the updated Terms.

Governing Law

These Terms are governed by the laws of California, United States, without regard to conflict of law principles. If any provision is held invalid or unenforceable, the remaining provisions will remain in effect.
